To bypass the CBI advice, CVO/RlyBd decided to bypass the CVC itself

Officers with far minor cases of misconduct have been removed under Rule 56J, why not Amitabh Banerjee? Why not Ramesh Jha?
A Vigilance report was sent by the Joint Secretary, Ministry of Heavy Industries to the CBI on 22.02.2017. After detailed preliminary enquiry, an FIR was filed by the Shillong office of the CBI on 04.03.2020. Yet the CVO of Railway Ministry, the Principle Executive Director (PED/Vig.), Ramesh Kumar Jha gave Vigilance clearance to Amitabh Banerjee in October 2020, thus enabling his appointment as CMD Indian Railways Finance Corporation (IRFC).
For appointment to the post of CMD of a PSU, Vigilance clearance should have been taken from the CVC, who in turn seek advice of the CBI and the IB. If the CVC had been asked, the matter of an existing CBI FIR would have definitely come to light. But, to bypass the CBI advice, Ramesh Jha decided to bypass the CVC itself. Ultimately, Amitabh Banerjee had to be sacked by the Railway Ministry for misconduct.
This is not the first time abuse the position
This is not the first time Ramesh Jha has abused his position. He also chose to give Vigilance clearance to Saish Agnihotri so that he could be appointed as the CMD of NHSRCL, the prestigious High Speed Rail Project being monitored by the Prime Minister himself. Satich Agnihotri also had to sacked by the Railway Ministry.
Recently Ramesh Jha got five GM empaneled officers entangled in old and dead Vigilance cases so that he himself could become a General Manager (GM). Five was the exact number, which if dropped from the panel, would have enabled Ramesh Jha to become GM.
Tarnished the image & career of brilliant officers
Earlier, Ramesh Jha had launched a vicious campaign to tarnish the image and destroy the careers of brilliant officers, who had built the first lot of Vande Bharat Express. Even in this case he had shown extreme partisan behaviour. Out of a dozen officers agaisnt who he had launched Vigilance cases, he gave Vigilance clearances to all except one for promotion to HAG+, HAG and SAG.
He also selectively put the name of just one officer in the Agreed List even though all 12 were accused of the same misconcduct. Due to these vicious and motivated acts of Ramesh Jha, at the behest of V. K. Yadav, the CRB, the production of Vande Bharat stopped for nearly four years.
Undermined the official heirarchy and protocol
Former PED/Vigilance/Railway Board Ramesh Jha, has not only bypassed the CVC at his whims, he has also undermined the official heirarchy and protocol within the Mnistry of Railways. In a Vigilance case, when the Member Finance (MF) and the Member Traction & Rolling Stock (MTRS) has clearly given a clean chit to their officers, Ramesh Jha decided to overrule them and sent the file to the CVC.
In the normal course the casse should have been closed at the Board level or if he was so sure of the misconduct, Ramesh Jha, PED/Vigilance, should have taken the approvsal of the CRB for overruling two Board Members.
Ministry is trying to whitewash the case
Even now, in the case of Amitabh Banerjee, the Railway Ministry is trying to whitewash the case wiel citing minor offences like converting his house into a rest house, purchasing furniture and towels and charging the UK visa fees to IRFC funds.
Why not Amitabh Banerjee?

There is a strong case to enquire into the conspiracy of Ramesh Jha in favouring some officers, harassing others, bypassing the CVC and the CRB, and dismiss him from government service without pension, or at least retire him under Rule 56J.
