By means of the present writ petition, the petitioner has questioned the impugned Revised Directive-32, dated 28th December, 2017 issued by respondent no. 2.
Further, the petitioner has prayed for a direction upon the respondent authorities to consider the grievance of the petitioner with regard to their transfer from Railway Protection Special Force to the desired/opted Zonal Railways in Railway Protection Force in pursuance of the existing Directives at the time of entering in their services.
Today, on the matter being taken up, learned counsel for the petitioners and the learned counsel for the respondents submit that the controversy involved in the present writ petition is more or less identical to those of Writ-A No. 37638 of 2017 (Harish Chandra & 62 Others Vs. Union of India & 5 Others), which has been decided by a Coordinate Bench of this Court vide order dated 2nd August, 2019.
In view of the aforesaid submissions, for the reasons recorded in the judgment and order dated 2nd August 2019 passed in the aforesaid writ petition, this petition is also allowed with same terms and conditions.
Accordingly, the Revised Directive-32, dated 28th December, 2017 issued by respondent no. 2 is set aside and quashed. It is provided that the petitioners transfer/placement shall be considered strictly under the concerned Standing Order as per their choice (O.M.R.) and seniority, provided, vacancies of Constables RPF are available in the preferred Zone, as on date.
