The making of panel and posting of DRMs is against the Art. 14 & i.e. equality before law

“There shall be equality of opportunity for all citizens in matters relating to employment or appointment to any office under the state!” Art. 16(i) of the constitution

When present CRB is left with only 45 days in office, most of the people fail to understand the reason of hurry behind issuing the postings order of 35 DRMs on 15th July, 2023 i.e. on holiday when the incumbent DRMs tenure was to be completed in August 2023

Sudheer Kumar knows that this was the only last most important thing to be done to keep alive the hold of mafia syndicates for next 10 years until unless, a sane, honest, unbiased and highly judicious Minister comes and dismantle all unjust, unconstitutional and mafia syndicate centric rules and regulations

Hon’ble Prime Minister is requested to personally monitor the whole matter related with DRM empanelment and postings and to give justice to the majority of officers by abrogating the DOB criteria in DRM empanelment and postings, and also the justice should be made to the people of last year panel

Rail is the lifeline of nation and anything which is disturbing and damaging to the basic structure and confidence of its committed workforce, hon’ble Prime Minister of this country certainly needs to step in to bring the things to justice, especially when the all stages of monitoring these things have failed because of some other priorities

We as a citizen of India need to see and read preamble of #Constitution from time to time just for the sake of remembrance so that we must not feel hapless and helpless in case of adversities and have #faith in the #Constitution and the people holding #Constitutional post. The preamble of #Constitution of India is quoted below is also to motivate the highly demotivated and dejected workforce of #IndianRailways.

You will find trails of biggest #bureaucratic fraud in appointing / posting by fixing the top key and decisive posts of #IndianRailways. This is not less than the sinister plans/fraud made by worlds dreaded mafia’s syndicates as it has not only caused millions and billions of financial loss/siphoning to the national exchequer but also wasted and halted several years of nations development. From the above chart it can be understood that how important #DRM post is within the Railway System, And without becoming #DRM you cannot even think of becoming #GM, #Member or #Chairman Railway Board. The way to top and top most post is through #DRM only. And to make it more clear it is THE post and its selection process, through which, one can keep his empire run over whole railway system regardless to the fact which political party runs the government and who is the Minister for Railways. The sinister syndicate of top Railway officers – which includes the Railway officers working in #MRCell – will fight its best to convince by confusing through their own logic justification to keep this #AgeCriteria/#DOB factor any how, in any form and by all means.

What makes #eligible one person for making him #DRM at the age of “53 years 8 months” and other less than that age #uneligible for the #DRMship?

52 years #criteria in itself creates #unequality of #opportunity in the same service and same batch. (in contravention of Art. 16 (i) of constitution of India).

Basically capping of 52 years or criteria like that gives #reservation in camouflage to the most of the people coming from well off background. Because the people from #poor and #backward background enter in the service comparatively late from the people who are born in affluent and educated family. The majority of people coming from poor background are victim of this repressive and unconstitutional age criteria.

It is also a fact that people from educated and well off background, knowing the importance of #DOB, used to change the #DOB of their children which is sometimes less than 5 or 6 years than their original #DOB.

Earlier we have also pointed out that the 52 years #DOB criteria is clearcut #backdoor_reservation for certain privileged people, with advantage of #DOB, in the same service and batch.

Moreover it becomes more interesting and more blatant when you say that this is not #promotion, but you know the importance of this post of #DRM in the railway system. If it is not promotion then why you are putting this unequal criteria of discrimination amongst the people who have not been discriminated by #UPSC while allotting the same service and batch?

And does #UPSC discriminated them on the basis of #DOB while allocating the service?

How the basic tenets of the constitution can be trampled one can learn from the mafia syndicate of Railway’s move by making 52 years/DOB criteria the sole criteria for becoming #DRM.

DRM is not promotion! OK.. Accepted..

But what about GM?

It is promotion na?

But you can become #GM only after if you have worked as #DRM. It is made one of the #mandatory criteria for getting selection as GM.

So it is something more subtle than promotion and it is reserved for the people with #DOB advantage with 52 years #DOB criteria.

In other words though posting in #DRM is not on promotion but it is on reservation only. Which provides benefit and edge to a certain miniscule section of privileged officers only in #Railways on the basis of Age/DOB from the very beginning and treating others as lesser mortals of lower origin.

Logically and legally it should have been with the spirit of constitution’s Art 16-(i) which reads, “There shall be equality of opportunity for all citizens in matters relating to employment or appointment to any office under the state”.

Legally, this type of rule where you are putting some #DOB or any #criteria which dilutes the “equality of opportunity” in #appointment/#posting – on such a post like #DRM – which is bound to affect your future progression in career and which is visibly blatantly against the spirit of Art 14 & Art 16 of the constitution of India; then in any case it requires the involvement of #parliament and this should be passed as a law through parliament of India. This is a hidden #methodology of backdoor reservation devised by cunning cabal of railway bureaucracy.

If it is not passed by the parliament of India then it is “unconstitutional ab initio” and the people should be held responsible under the relevant section of #IPC & #CrPC for conceptualizing, enacting and implementing it.

If judicial audit and honest investigation is done on this – DRM panel and posting – then it is going to be proved as the biggest #व्यापम type of #ghotala in the history of Indian Bureaucracy.

Railway Board by its self created such rules which creates #unequals among #equals. The #tribal instinct and #corrupt intent of top Railway Officers, who reached on top through this #DOB gimmick only, is so overpowering that they cunningly defy the tenets and spirit of constitution of India and they make political Bosses so blind that they hardly heed towards this during their tenure and fall pray to their trap.

When present #Chairman & CEO /Railway Board (#CRB) is left with only 45 days in office, most of the people fail to understand the reason of hurry behind issuing the postings order of 35 #DRMs on 15th July, 2023 i.e. on #holiday when the incumbent #DRMs tenure was to be completed in August 2023. It is learnt from the reliable sources in the #RailwayBoard that #MR has given this task to his #advisor Sudheer Kumar to take a decision on the panel and posting of #DRMs in consultation with #CRB.

Interestingly, it is heard that #SudheerKumar has been relieved from his office just one day after the issuing the posting orders of #DRMs. If this is true and not done as a plot then it is also smart move because #SudheerKumar knows that this was the only last most important thing to be done to keep alive the hold of mafia syndicates for next 10 years until unless, a sane, honest, unbiased and highly judicious #Minister comes and dismantle all unjust, unconstitutional and mafia syndicate centric rules and regulations. Moreover, from this monsoon session onward time will be very tough for the #government till the next year general election so it was right time to exit for Mr Sudheer Kumar.

Hon’ble Prime Minister is requested to personally monitor the whole matter related with #DRM empanelment and postings and to give justice to the majority of officers by abrogating the #DOB criteria in DRM empanelment and postings, and also the justice should be made to the people of last year panel which is also the first panel, which has given the #EQI test, by giving them chance to work as #DRM. This will not only ensure justice to all, but also by making whole panel of 76 people to give chance to work as DRM, will give the actual feedback on the first experiment of its kind while making selection for a key post in the Indian Railway apart from ensuring the “equality of opportunity” where even in March 2023 officers are posted at the age of 53 years and 8 months. So people atleast less than that i.e. 53 years 8 months must get the posting of #DRM for the sake of justice. Railway Board must also published the result/score of #EQI_Test given by empanelled 76 officers last year.

From the same panel you have posted the eldest and oldest one in March 2023 i.e. 3 months back only. From the same panel you have made eldest person #DRM, in March 2023, at the age of 53 years 8 month, then why people in the same panel with age less than 53 years 8 months could not be found illegible for posting and working as #DRM in the posting list issued on 15.07.2023?

And without giving them opportunity, what was the hurry to make a new panel with new cut-off-date and that too with new age-cut-off?

Is it justice?

Does it mean that you were interested in placing only upto that officer who is made #DRM at age of 53 years and 8 months?

Moreover what is your golden rule of age-cut-off for making #DRM panel? 52 years?

Because if it is 52 years then why you have made cut-off-date 1st July 1970 for the posting to be made against the #vacancy of 35 #DRMs arising in August 2023, for which you have issued order on 15th July 2023 i.e. on Saturday which was holiday?

Means this time cut-off-age is kept 53 years to post #DRMs and not 52 years. Is it not clear case of authority who misconstrue authority?

Means people born after 1st July 1970 and upto 53 years are perfectly eligible to become #DRM in 15th July 2023 posting orders; and also people are perfectly #eligible at the age of 53 years 8 months in the posting order of March 2023 but people between the age bracket of 53 years and 53 years 8 months are out of consideration inspite of being in the same panel through which #RailwayBoard has posted #DRMs in March 2023. This defies all logic and tenets of jurisprudence.

Time to time #RailwayBoard further makes it blatantly more manipulative by tactically delaying #DRM panel even by more than one year.

#RailwayBoard through its tactical delaying tactics, in making #DRM panel, it weeds out targeted people and ensure favour to the people of their choice.

Is it not sheer #arbitrary? And shows that key people at the helms of affair in ministry of railway are making rules and bench mark as per their whims and fancy like a despot?

The rules of making #DRM panel and posting neither favour socially backward and marginalized officers nor professionally competent, committed and honest officers but it is made to only favour and provides clear reservation to the people born with the #DOB advantage who knows from the date of joining in the #Railway that they will become #DRM, #GM etc even without doing anything.

(The #cunning cabal of #mafia_syndicate will give logic of old panel vs new panel. The concept of panel and the basic premise on which #RailwayBoard makes the #DRM panel, in itself, is vitiated, unjust and unconstitutional as elaborated above).

DRM postings and implementation of #rotational #transfer and #postings of staffs and officers are the two key aspect of Railway working and until unless the basic tenets of article 14 and article 16 of constitution of India are not respected and implemented in true spirit, railway will be keep on bleeding through the hands of cunning cabals of bureaucratic mafia syndicate of railway.
