It is not permitted to accommodate resigned person in Federations at Railway Board level

Railway Board is directly involved to encourage corrupt practices by allowing retired & resigned persons to continue negotiations

Hubballi: The letter of the Indian Railway Mazdoor Union (IRMU), objecting to the elevation of N. Kanniah as the President of All India Railwaymens’ Federation (AIRF).

IRMU writes that “as per the instructions issued by the Board, it is not permitted to accommodate a resigned person in recognised Federations at Railway Board level. Despite having such clear information, Railway Board has allowed resigned person, i.e. N. Kanniah, to be a part of Trade Union/Federation.”

“The said person has joined Railways on 02.08.1971 and absorbed as “PORTER” in regular service w.e.f. 11.01.1979, and later resigned, and his resignation was accepted by Railway Administration vide SrDPO/MAS’s letter no. M/P(S)/578/III/12/TE/VOL.VI(Pt), dated 23.04.2008.”

The letter said that “the aforesaid person cannot continue as an office bearer in any Union or Federation with respect to section 22 of Trade Union Act, 1926 and chapter XXV, part B & C of IREM Vol.II (statutory provisions declared by the Supreme Court of India).”

“It is said that, earlier also the same was brought out to the knowledge of Railway Board vide IRMU letter dated 13.02.2018.”

“Despite such glaring Acts, Rules, Instructions and Guidelines, Railway Board has made up its mind and is involved directly to encourage corrupt practices by allowing resigned people to continue negotiations and has proven for the last so many years.”

“Therefore, at least by now, Railway Board shall open an eye to protect the laws of the land and expel such resigned people out of Railway Establishment on top priority”, said by IRMU.

It is rightly pointed out in their letter that “No Resigned Person can be part of any recognised Federation as per the Railway Board’s circular dated 31.05.2013”.

Initially a “Porter” N. Kanniah has also held the post of the Chairman of the RECCS Ltd (Chennai Society) for the last two decades.

There were many complaints against him from the members of the Society in the past about mismanagement of funds and undemocratic control of the Society.

Though the Railway Administration has recommended CBI to enquire about his disproportionate property, income & assets, nothing was done against him by CBI or any other agencies of government till date.

It is astonishing that such a person, who was not even eligible to occupy his previous post (working president of AIRF), is so called elected unanimously by the other office bearers of AIRF as President.

Also, the fact that no other Federation or major Unions in the Railways made any objection to the elevation of N. Kanniah to such a key post till date clearly shows his influence and clout.

In this scenario it is heartening to see that at least one Railway Union is showing the sense and courage to challenge the elevation of a “resigned person” like N. Kanniah to the post of the President of the largest Railway Federation – AIRF.
