CGM-S&T-IRCON #PVSrikanth is playing with #Safety and evaded the #Tender-conditions and directives of General Conditions of Contract (#GCC) issued by Ministry of Railways, Central Vigilance commission (#CVC), Hon’ble Supreme Court and General Financial Rules (#GFR) issued by Ministry of Finance.

The directives as regards public procurements by Public Sector Undertaking (#PSU) is totally destroyed by #IRCON International Limited under Ministry of Railways.

#DyCSTE/Project/Hubli, South Western Railway under PCSTE/SWR invited a tender no. SG-SWR-Proj-KAVACH-SBC dt. 17.01.2025 for KAVACH over 778 RKM of #Bengaluru and #Mysuru Divisions of South Western Railway @ ₹191.82 Crore.

CGM-S&T-IRCON, quietly invited one Delhi based firm M/s Agarwal Engineers and Rail Infrastructure Limited, and took Pre-bid offer and made arrangement of MOU for pre-bid tie-up on 16.01.2025.

CGM-S&T-IRCON took revised offer on 03.04.2025 from M/s Agarwal Engineers and Rail Infrastructure Limited.

IRCON International Limited was awarded participated in the tender and became Lowest One (L-1).

PCSTE/SWR awarded the tender to IRCON, without proper negotiations, through LOA no. UBL-PROJECT-S AND T/ SG-SWR-PROJ-KAVACH-SBC/01346260129722 dt. 20.05.2025 at very HIGH cost of ₹253.56 Crores as against Railway’s estimated cost of ₹191.82 Crore which is ₹64 crores higher than the #SWR’s estimated cost.

CGM-S&T-IRCON, without inviting any tender awarded part of the contract of OFC and Tower works through letter no. IRCON/SWR-PROJ-KAVACH/LOA/2 dt. 02.06.2025 at total cost ₹135.19 crore to firm M/s Agarwal Engineers and Rail Infrastructure Limited, without proper negotiation and without obtaining work experience certificate.

As per reliable source information, #PCSTE/SWR has given approval for such sub-contractor to IRCON.

  • Violation-1: CGM-S&T-IRCON has wilfully disregarded the conditions of GCC 7a that sub-contractor must have experience of work to the extent of 35% as per GCC. No work experience certificate of 35% was obtained.
  • Violation-2: As per GCC para 7a Total value of work to be assigned to sub-contractor shall not be more than 50% of total contract value. CGM-S&T-IRCON awarded the sub-contract for more than 53% which is illegal.
  • Violation-3: CGM-S&T-IRCON has violated CVC directives that NO back-2-back tender is to be awarded. Open tender is to be invited for selection of sub-contractors. In this case No transparency in selection of contractor for the back-2-back tie-up was done, which is the main source of #Corruption as specified by #CVC vide office memorandum dt. 20.10.2003.
  • Violation-4: CGM-S&T-IRCON has not uploaded the awarded LOA on IRCON’s website which is gross violation of CVC norms as specified by CVC office order No. 13/3/05 dt. 16.03.2005 and office order no. 57/9/05 dt. 20.09.2005.
  • Violation-5: CGM-S&T-IRCON has disregarded the directives of Hon’ble Supreme Court of India as brought out by CVC through office order No. 23/7/07 dt. 05.07.2007.
  • Violation-6: PCSTE/SWR has approved subletting more than 50% and to agency who is NOT having any experience.
