No punitive steps shall be taken against Anil Kumar, till the order passed on his representation

CAT ORDER

The applicant (Anil Kumar) is an outstanding officer of Senior Administrative Grade (SAG) in the Railways. He was working as Chief Mechanical Engineer in the Modern Coach Factory, Raebareli.

Through an Railway Board order dated 16.07.2020, he was transferred to the East Central Railways, to be posted in the cadre. He has filed a petition (OA) in the CAT, Principal Bench, Delhi challenging the order of transfer.

The applicant Anil Kumar contends that he has meritorious service of record for the past more than two decades and he was also rewarded on certain occasions.

He submitted that the order of transfer is motivated and was issued at the instance of some superiors.

It is also pleaded that the administration itself has issued instructions to stop transfers on account of the current Covid-19 pendamic. Other grounds are also urged.

The transfers were effected on 16.07.2020. It is also brought to the notice of the CAT that the applicant has since been relieved from the post, which he was holding, before the transfer.

The applicant filed a detailed representation dated 25.08.2020 to the concerned authority, narrating his grievances. In the view that the representation needs to be disposed of at the earliest.

Therefore, CAT directed the respondents to pass orders on the representation dated 25.08.2020, submitted by the applicant, within a period of two weeks, from the date of receipt of a certified copy of this order.

CAT also direct that in case the applicant did not join the place, to which he was posted, no punitive steps shall be taken, till the orders are passed on the representation.

As per information, certified copy of the above order of the CAT issued on Tuesday, 15th September, 2020.
