CBI booked Chief Engineer of NWR, and WCR & ESIC officials for illegal gratification

Criminal Conspiracy, obtaining of #bribe by public servant, #Bribing a public servant by private persons, and commercial organization and officers, and abetment of offences under PC Act 1988

A reliable source information has been received by the CBI to the effect that some public servants of North Western Railways (#NWR), Jaipur, Rajasthan; West Central Railways (#WCR), Jabalpur, Madhya Pradesh and Employee’s State Insurance Corporation (#ESIC), Mandsaur, Madhya Pradesh, in conspiracy with Mukund Chamaria and other directors of M/s Dony Polo Udyog Ltd., Shamgarh, Madhya Pradesh, Kanaiya Lal Gupta and Gourav Kalra, both employees of M/s Dony Polo Udyog Ltd., Pawan Tapadiya and Natraj Ladda aka Nandu, both Directors of M/s Vishal Nirmiti Pvt. Ltd. and Jagdish Ghanshyam Bissa, employee of M/s Vishal Nirmiti Pvt. Ltd., Bankhedi are indulging in #corrupt practices and obtaining illegal gratifications from the said private persons/entities for showing favours in award and execution of work, extension of date of supply and clearing of bills.

Source has also informed that, #KGAgrawal, Chief Engineer (CE), NWR, instructed Kanhaiya Lal Gupta to meet him in person, failing which, they would not get #CRC for loading and unloading of Railway #Sleepers at Gangadhar, Rajasthan. Under instructions of Directors of M/s Dony Polo Udyog Ltd., Kanhaiya Lal Gupta agreed to pay #bribe to KG Agrawal, CE/NWR, pursuant to which a bribe amount of Rs.25,000/- was delivered to KG Agarwal through Gourav Kalra. However, KG Agrawal was displeased with the meager amount of bribe and shouted at Kanhaiya Lal Gupta that the amount of Rs.25,000/- was not commensurate to the rank of #ChiefEngineer. Kanhaiya Lal Gupta, in turn, assured KG Agrawal that he would pay more bribe.

The source has further informed that M/s Dony Polo Udyog Ltd., Shamgarh and its directors are also indulging in corrupt practices and bribing some officers of West Central Railways in lieu of favours in award and execution of works, extension of dates and clearing of bills, as well as officers/officials of Employees State Insurance Corporation, Mandsaur in lieu of favours in matters pertaining to default payment of the company and managing pending matters.

Source also informed that a huge order for the supply of railway sleepers was awarded recently to M/s Dony Polo Udyog Pvt Ltd., Shamgarh, and M/s Vishal Nirmiti Pvt. Ltd., Bankhedi by West Central Railways, Jabalpur, Madhya Pradesh for joint execution in proportion decided by the railway authorities. Kanhaiya Lal Gupta and Jagdish Ghanshyam Bissa, under instruction of their respective directors are in touch with Ashok Kumar, Dy. CMM, Sushant Kumar, SSE (Engineering Department), and Shailendra Kumar, Store Assistant, WCR, Jabalpur for early issuance of purchase order (PO). However, Ashok Kumar, Dy. CMM, instructed Kanhaiya Lal Gupta to discuss with Tapadia about their commitment of payment of bribe.

On the same day, Kanhaiya Lal Gupta discussed with Natraj Ladda @Nandu and they agreed to pay Rs. 2 lacs @ Rs.5 per sleeper to Ashok Kumar, Dy. CMM. Vinay Chamaria, Director of M/s Dony Polo Udyog Ltd. instructed Kanhaiya Lal Gupta that bribe amount would be shared by M/s Dony Polo Udyog Ltd. and M/s Vishal Nirmiti Pvt. Ltd. in proportion to the orders placed on the companies and instructed Kanhaiya Lal Gupta to deliver their part of the bribe amount to Jagdish Ghanshyam Bissa of Vishal Nirmiti Pvt. Ltd., for onward delivery to Ashok Kumar, Dy. CMM, WCR, along with share of M/s Vishal Nirmiti Pvt. Ltd.

Source has also informed that on 03.01.2025, Ashok Kumar, Dy. CMM again pursued with Kanhaiya Lal Gupta for payment of bribe and asked when would he meet his commitment. Kanhaiya Lal Gupta informed that he had already instructed Jagdish Ghansyam Bissa of M/s Vishal Nirmiti Pvt. Ltd. for making payment.

Source has also informed that on 08.01.2025, Shailendra Kumar, Store Assistant, WCR, Jabalpur complained to Kanhaiya Lal Gupta that he received
only Rs. 2000/-, which was too little for the favours he had shown to them. After discussing the matter with Prahlad Chamaria and Mukund Chamaria, Kanhaiya Lal Gupta paid an additional bribe of Rs. 3000/- to Shailendra Kumar through Gourav Kalra on 09.01.2025.

Source has further informed that on 06.02.2025, Kanhaiya Lal Gupta informed Sushant Kumar, SSE (Engineering Department), WCR, Jabalpur, resident of B-101, Jahangir Apartment, Civil Lines, Jabalpur, MP that he had sent an envelope containing bribe through Gourav Kalra, who was coming to Jabalpur. Thereafter, on 07.02.2025, Gourav Kalra delivered the said
envelope to Sushant Kumar.

Source information further revealed that on 06.01.2025, Shree Chandra Budhwani, Consultant, occupying a chamber in ESIC Office, Mandsaur demanded bribe from Kanhaiya Lal Gupta for getting regularized default payments of his companies and for managing their pending matter with the office of ESIC. After discussion with Mukund Chamaria, Kanhaiya Lal Gupta met Shree Chandra Budhwani, after which he informed Mukund Chamaria that Shree Chandra Budhwani had demanded Rs. 3 lakhs for regularising default payments, which also included share of ESIC Officers.

Mukund Chamaria instructed Kanhaiya Lal Gupta to arrange for delivery of bribe at the earliest. On 13.01.2025, part payment of Rs. 2 lakhs was made to Shree Chandra Budhwani. Mukund Chamaria also instructed that the rest of the amount be paid once the work is done. Source has further revealed that on 07.02.2025, Shree Chandra Budhwani again pursued with Kanhaiya Lal Gupta for payment of the remaining Rs. 1 lakh at the earliest and Kanhaiya Lal Gupta assured early payment.

Source has further informed that KG Agarwal, CE/NWR instructed his junior not to issue CRC favouring M/s Dony Polo Udyog Ltd. without his permission. Even though the RO was issued for delivery of approx. 20,000 sleepers, the CRC was held back. KG Agarwal conveyed to Kanhaiya Lal Gupta that CRC won’t be issued unless the demanded bribe amount is delivered to him. After discussion with Mukund Chamaria, Kanhaiya Lal Gupta instructed Gourav Kalra, to go to Jaipur on 19.02.2025. The source has informed that Gourav Kalra, under instructions of Kanhaiya Lal Gupta, employee of M/s Dony Polo Udyog Ltd. has proceeded to Jaipur and would deliver the bribe amounts to KG Agrawal on 19.02.2025.

Source has further informed that apart from payment of bribe to K. G. Agarwal, Kanhaiya Lal Gupta also agreed to pay bribe to Ashish Kumar Meena of Accounts Division of NWR, Jaipur for early processing of bills of M/s Dony Polo Udyog Ltd. for payment. Gourav Kalra has also carried the bribe to be paid to Ashish Kumar Meena and would deliver the bribe to Ashish Kumar Meena also on 19.02.2025.

The aforesaid information discloses commission of cognizable offence(s) U/s 61(2) of BNS 2023 r/w Sections 7, 7A, 8, 9, 10 & 12 of Prevention of Corruption Act 1988 (as amended in 2018) and substantive offences thereof by the said (1) KG Agrawal, Chief Engineer, NWR, Jaipur, (2) Ashish Kumar Meena, Accounts Division, NWR, Jaipur, (3) Ashok Kumar, Dy. CMM, WCR, Jabalpur, (4) Sushant Kumar, SSE (Engineering Department), WCR, Jabalpur, (5) Shailendra Kumar, Store Assistant, WCR, Jabalpur, (6) Prahlad Chamaria, (7) Vinay Chamaria, (8) Mukund Chamaria, 9) Kanhaiya Lal Gupta, (10) Gourav Kalra, (11) M/s Dony Polo Udyog Ltd. (12) Natraj Ladda @Nandu, (13) Jagdish Ghanshyam Bissa, (14) M/s Vishal Nirmiti Pvt. Ltd., Bankhedi, M.P, (15) Shree Chandra Budhwani and other unknown private persons and public servants. A regular case (RC 216 2025 A 0003, 19.02.2025) is, therefore, registered and entrusted to Ankit Meena, Dy. SP, CBI, AC-I for investigation.
