Suspected Offences: Criminal conspiracy, public servant obtaining undue advantage for dishonest performance of duty, giving undue advantage to public servant for improper performance of duty

A complaint dated 10.01.2024 has been received from Smt. Anita Barik, Deputy Chief Vigilance Officer/Traffic, South Central Railway, General Manager’s office, Vigilance Branch, Secunderabad, wherein it has been alleged that Shri B. Kishore Kumar, Peon to #SrDOM, #SCRailway, Guntur Division close aide of Shri P. Kiran Kumar, Sr. DOM, S C Railway, Guntur had demanded and collected #bribe amount on behalf of Shri P. Kiran Kumar (#IRTS-2013) from Operating Employees working at different stations over #GunturDivision for transfers, postings, sanction/regularization leaves and forwarding Inter-Railway Request Transfer applications.

It is further alleged that Shri P. Kiran Kumar was working as Senior Divisional Operations Manager (Sr.DOM), South Central Railway, Guntur during relevant period i.e. during May, 2023-July, 2023. Shri B. Kishore Kumar was working as Peon in office of Senior Divisional Operations Manager (Sr.DOM), South Central Railway, Guntur during relevant period and he was attached with Shri P. Kiran Kumar. Shri Chikkala Rohit has close acquaintance with Shri B. Kishore Kumar and he is also a distant relative of Shri B. Kishore Kumar.

It is alleged that the following persons were working under Shri P. Kiran Kumar, Senior Divisional Operations Manager (Sr.DOM), #SouthCentralRailway, Guntur as operating employees at different #Railway stations under #SCRailway, #GunturDivision:

  1. Shri #ManishKumar, Station Master (#SM), Tipparthi Railway station, South Central Railway, Tipparthi, Telangana.
  2. Shri #AbhinavKumar, Station Master (SM), Nalgonda Railway Station, South Central Railway, Nalgonda, Telangana.
  3. Shri #ALeelaKrishna, Station Supdt. (#SS), Namburu Railway Station, South Central Railway, Namburu, Andhra Pradesh.
  4. Shri #BadigantalaShekhar, Assistant Points Man (#APM), Guntur Railway station, South Central Railway, Guntur, Andhra pradesh.
  5. Shri Ch. #DilleswaraRao, Points Man (#PM), Guntur Railway Station, South Central Railway, Guntur, Andhra pradesh.
  6. Shri #Nagaraju, Points Man (PM), Namburu Railway Station, South Central Railway, Namburu, Andhra pradesh.
  7. Shri #LShimhadriNaidu, Points Man (PM), Mangalgiri Railway Station, South Central Railway, Mangalgiri, Andhra pradesh.

  11. Shri #DBalakrishna, Station Master (SM), Kondrapole Railway Station, South Central Railway, Kondrapole, Telangana.

It is further alleged that Shri Manish Kumar; Station Master (SM) transferred Rs.6000/- on 22.06.2023 through PhonePe to the account of Shri Chikkala Rohit and thereafter his absent period was regularised by Shri P. Kiran Kumar, Sr.DOM/GNT vide letter dated 22.06.2023.

It is also alleged that Shri #BKishoreKumar, Peon demanded on behalf of #SrDOM #PKiranKumar to pay Rs.30,000/- to forward inter-railway request transfer application of Shri Abhinav Kumar, Station Master (SM). Shri Abhinav Kumar, Station Master (SM) paid Rs.20,000/- on 22.06.2023 and Rs.10,000/- on 23.06.2023 through PhonePe to the account of Shri #ChikkalaRohit. Subsequently, his inter-railway request transfer application was forwarded by Shri P. Kiran Kumar.

It is further alleged that Shri A. Leela Krishna while working as SS/Nallapadu, he registered his request transfer to Tl/Safety. On 06.06.2023, he received telephone call from Shri B. Kishore Kumar, peon and he was advised to come to Sr.DOM P. Kiran Kumar’s office at 10.00 AM on 07.06.2023. Accordingly, Shri A. Leela Krishna met Shri P. Kiran Kumar on 07.06.2023. Thereafter, Shri B. Kishore Kumar demanded Rs. 30,000/- and Shri A. Leela Krishna paid the same through UPI on 07.06.2023. Since his application for the post of Tl/Safety is not considered, the said amount was returned to Shri A. Leela Krishna.

It is further alleged that Shri Badigantala Shekhar, Assistant Points Man (APM), Shri Ch. Dilleswara Rao, Points Man (PM), Shri Nagaraju, Points (PM), Shri L. Shimhadri Naidu, Points Man (PM) and Shri K. Mohan Rao, Points Man (PM) met Shri P. Kiran Kumar Sr.DOM/GNT in his chamber in the first week of June, 2023 for forwarding of their inter-railway request transfer applications. Shri B. Kishore kumar, peon has demanded Rs. 10,000/- from each one of them for forwarding their applications. Thereafter, Shri Badigantala Shekhar, Shri Nagaraju, Shri L. Shimhadri Naidu and Shri K. Mohan Rao transferred Rs.40,000/- in total to the account of Shri Ch. Dilleswara Rao. In turn, Shri Dilleswara Rao paid Rs.40,000/- on 16.06.23 and Rs.10,000/- on 17.06.23 through UPI payment to the account of Shri Chikkala Rohit. Thereafter, their applications were forwarded by Shri P. Kiran Kumar.

It is further alleged that Shri V. Dora Swamy, Station Master (SM)/Station Supdt.(I/C) met Shri P. Kiran Kumar as per his instruction wherein he was South Central Railway, Mangalgiri, Andhra Pradesh advised to improve his performance. On 08.06.2023, Shri V. Dora Swamy received call from Shri B. Kishore Kumar, Peon through which he was told that he was getting transfer to Vishupuram and he was told that if he arranges money for purchase of mobile phone for Shri P. kiian Kumar, his proposed transfer will be cancelled. Accordingly, he transferied Rs.45,400/- to M/s. Little Planet Mobile Showroom, Guntur on 09.06.2023 for purchase of mobile for Shri P. Kiran Kumar. He also transferred Rs.5000/- on 02.07.2023 to the account of Shri Chikkala Rohit towards purchase of grocery etc. for Shri P. Kiran Kumar.

It is further alleged that Shri J. Rajshekhar Reddy, Tl/Planning met shri P. Kiran Kumar, Sr.DOM/GNT in a hotel namely Blue Restaurant, Guntur on 02.06.2023, where Shri P. Kiran Kumar demanded Rs. One lakh for posting him as Tl/Staff. Shri J. Rajshekhar Reddy also paid Rs. 5021/- towards hotel bill on the same day to Blue Restaurant. Then, Shri J. Rajshekhar transferred Rs. 80,000/- to the account of Shri B. Kishore Kumar, peon on 05.06.23 through Google Pay and paid Rs. 20,000/- on 06.06.2023 through cash to Shri B. Kishore Kumar. The posting order in favour of Shri Reddy was issued on 05.06.2023 by Shri P. Kiran Kumar. He also paid Rs. 10,200/- on 30.05.2023 towards UPS Exide Battery for the use of Shri P. Kiran Kumar to M/s. Guntur Motor Stores through PhonePe.

It is also alleged that in the month of June, 2023, Shri D. Balakrishna, Station Master (SM) met Shri P. Kiran Kumar, Sr.DOM/GNT for sanction of two months leave which was refused by shri P. Kiran Kumar. Shri D. Balakrishna again came to office of shri P. Kiran Kumar on 23.06.2023 and met Shri B. Kishore Kumar for sanction of his leave and Shri B. Kishore Kumar demanded Rs. 30,000/-. On the same day, Shri D. Balakrishna and Shri B. Kishore Kumar met Shri P. Kiran Kumar in his chamber and Shri Balakrishna agreed to pay Rs.15,000/- far sanction of one month leave
from 01.07.23 to 31.07.23. He paid Rs.15,000/- through PhonePe on 23.06.23 to Shri Chikkala Rohit and Shri P. Kiran Kumar sanctioned one month leave to Shri D. Balakrishna. Shri B. Kishore Kumar had given the phone number 9493379277 of Shri Chikkala Rohit to Shri D. Balakrishna for making the payment.

Thus, Shri P. Kiran Kumar conspired with Shri B. Kishore Kumar, peon and Shri Chikkala Rohit, Private Person and other public servants and in pursuance to conspiracy, on the instructions of Shri P. Kiran Kumar Shri B. Kishore Kumar, Peon demanded and accepted illegal gratification from the other public servants for doing official favour in the matter of transfers, postings, sanction/regularization leaves and forwarding Inter-Railway Request transfer applications etc. directly to his account or through account of Shri Chikkala Rohit. Further, after receiving above said gratifications, Shri B. Kishore Kumar; Peon handed over the same to Shri P. Kiran Kumar.

As the complaint prima-facie discloses commission of cognizable offences punishable under sections 120-B of IPC and under sections 7 and B of the PC Act (as amended in 2018), a Regular case is registeied against shri P. Kiran Kumar; Shri B. Kishore Kumar; Shri Chikkala Rohit, Shri Manish Kumar, Shri Abhinav Kumar, Shri A. Leela Krishna, Shri Badigantala Shekhar, Shri Ch. Dilleswara Rao, Shri Nagaraju, Shri L. Shimhadri Naidu, Shri K. Mohan Rao, Shri V. Dora Swamy, Shri J. Rajshekhar Reddy, Shri D. Balakrishna and unknown public servants and private persons.
